These Terms & Conditions govern the services provided by Ten Star Websites. By placing an order for any of our services, you agree to be bound by these Terms & Conditions. Please read them carefully before purchasing any of our services.
1. Our Services
Ten Star Websites provides professionally managed website services for businesses.
Depending on the service plan you choose, your plan may include:
- Website creation at no additional charge as part of your selected service plan.
- Website hosting.
- Website management.
- Website maintenance.
- Content updates and changes in accordance with your selected plan.
- Email support.
The exact features included will depend on the service plan you purchase.
2. Placing an Order
When you place an order through our website, you confirm that:
- The information you provide is accurate.
- You have the authority to enter into this agreement.
- You agree to these Terms & Conditions.
Your order is accepted once we confirm it and begin providing the agreed service. No work will begin until your order has been accepted by Ten Star Websites.
3. Payments
The price of your selected service plan will be shown before you complete your purchase.
Where your chosen plan includes recurring payments, the amount, frequency and billing schedule will also be displayed before payment is made.
By completing your purchase, you authorise the applicable payments for your selected service plan.
4. Website Creation
Website creation is included as part of your selected service plan and is provided at no additional website design charge.
To enable us to complete your website, you may be asked to provide information such as:
- Business name.
- Logo.
- Contact details.
- Images.
- Written content.
- Opening hours.
- Social media links.
- Any other information reasonably required.
Delays in providing this information may delay completion of your website.
5. Website Changes
Your selected service plan may include content updates.
Examples include:
- Updating contact details.
- Changing opening hours.
- Replacing photographs.
- Editing existing text.
- Updating services.
Major redesigns, additional pages, custom development or work outside your selected plan may incur an additional charge. We will always discuss any additional costs with you before carrying out chargeable work.
6. Hosting & Maintenance
While your service remains active, we will use reasonable efforts to:
- Host your website.
- Carry out routine maintenance.
- Keep your website operational.
- Apply appropriate updates where necessary.
Although we aim to provide a reliable service, we cannot guarantee uninterrupted availability at all times due to circumstances beyond our reasonable control, including third-party hosting, internet or domain provider issues.
7. Domain Names
Where we register or manage a domain name on your behalf, Ten Star Websites will own and administer the domain during the period that your service remains active.
If your service is cancelled, you may request that the domain name is transferred to you or to another registrar or provider, subject to the applicable registrar's transfer requirements and any outstanding obligations relating to the service.
8. Customer Responsibilities
You are responsible for ensuring that:
- The information you provide is accurate.
- You have permission to use any images, logos, text or other materials supplied to us.
- Your content does not infringe any copyright, trademark or other legal rights.
- Your website content complies with applicable laws.
9. Cancellation
You may cancel your service at any time by contacting us by email at info@tenstarwebsites.co.uk.
Following cancellation:
- Your service will continue until the end of your current paid service period.
- No further recurring payments will be taken after cancellation takes effect, except for any payment already due or authorised before cancellation was processed.
- Your website will be taken offline at the end of the paid service period unless another agreement has been made.
- You may request the transfer of a domain name that we registered or managed for you, subject to registrar requirements and any outstanding obligations.
10. Cancellation & Refund Policy
10.1 Cancelling Your Service
You may cancel your service at any time by emailing us. Please include your name, business name, website address and enough information for us to identify your account. We will confirm your cancellation by email once it has been processed.
10.2 When Cancellation Takes Effect
Unless we agree otherwise, your cancellation will take effect at the end of the service period you have already paid for. Your website will normally remain online until the end of that paid period. Once the paid period ends, the website will be taken offline and the services included with your plan will stop.
10.3 Initial and Advance Payments
Some service plans may require payment in advance for an initial service period. The amount charged, the period covered and any future recurring payments will be displayed before you complete your purchase.
If you cancel, any refund entitlement will depend on the circumstances, the services already provided and your rights under applicable UK consumer law.
10.4 Refund Requests
Refund requests will be considered in accordance with applicable UK consumer law.
When reviewing a refund request, we may take into account:
- When the order was placed.
- When the service began.
- The work and services already provided.
- Any domain, hosting or third-party costs already incurred.
- The length of the paid service period already used.
- Whether the service supplied was faulty or materially different from what was agreed.
Nothing in these Terms limits or removes any statutory rights that you may have.
10.5 Services Already Provided
Where you ask to cancel after we have begun providing the service, any refund may be reduced to reflect the proportion of the service already supplied and reasonable costs already incurred.
Where the paid service period has already been fully provided, a refund will not normally be due unless required by law.
10.6 Problems With the Service
Please contact us promptly if you believe that:
- The service has not been provided with reasonable care and skill.
- The service is materially different from what was agreed.
- Your website has a problem that we have failed to address within a reasonable time.
We will investigate the issue and, where appropriate, offer a repair, repeat performance, partial refund or another remedy required by law.
10.7 Website Content and Files
You remain responsible for the business content you provided to us, such as your logo, photographs and written information.
Our templates, code, design framework, systems and other proprietary materials are not transferred when the service ends unless we expressly agree otherwise in writing.
10.8 Chargebacks and Payment Disputes
Please contact us before raising a chargeback or payment dispute so that we have an opportunity to investigate and resolve the matter. This does not affect your right to contact your card provider or payment provider where appropriate.
11. Intellectual Property
You remain responsible for the ownership of any content that you provide to us.
Unless otherwise agreed in writing, Ten Star Websites retains ownership of its proprietary website templates, software, systems and design framework used to provide the service.
12. Limitation of Liability
We will use reasonable care and skill in providing our services.
To the fullest extent permitted by law, we shall not be liable for any indirect or consequential loss arising from circumstances beyond our reasonable control, including failures of third-party hosting providers, internet services or domain registrars.
Nothing in these Terms excludes liability where it cannot legally be excluded.
13. Changes to These Terms
We may update these Terms & Conditions from time to time. The latest version will always be available on our website and will apply from the date it is published.
14. Applicable Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes arising in connection with these Terms & Conditions shall be subject to the legislation and jurisdiction of England and Wales.
